I bought his JSX on Reverb, but he also listed here viewtopic.php?p=1914520#p1914520 Notice the footswitch pictured for it. He lists as "MINT, LIKE NEW", it shows up like this:
01313_9loUJWGGELw_600x450.jpg

Pictures a brand new footswitch, sends me this:
00r0r_bzZEM7buKT9_600x450.jpg
He put an amp cover over the heaed, wrapped it in a garbage bag, and did a one-pass wrap around it with thin bubble-wrap, chucked it in the box with NO packing around the sides, bottom, top, corners, NOTHING. It just flopped around loose in the box. I'm am surprised it showed up in one piece! Then, plugging it in, it sounds like SHIT. I had both the master and channel volumes at noon, and it hardly had any volume, sounded like ass. Obviously the tubes.. I bought a quad of JJ KT77's for $82, installed them, swapped out the 12AX7's, and it fixed it. HUGE difference.

This guy knew what he was doing, and really didn't give a shit. BEWARE - HE HAS MORE STUFF FOR SALE!

WOW....What a complete shithead :gethim: Sorry to hear about your troubles with this puke!!! And thanks for the headsup

I am really sorry I have not been able to respond to your emails. My internet has been down all week. Please check your email I emailed you a few minutes ago.

Shit happens, I understand. I moved on to a paypal claim, but I would really prefer to keep the amp. As I've stated with you, all I ask is that you take responsibility for the amp NOT BEING LIKE NEW, and adjust the price accordingly. In addition, you offered to send me new tubes, but that is not necessary. Instead of spending the money, just reimburse me for the quad I bought from Tube Depot.

I don't see any of this as unreasonable. You have been combative since your first response. You totally avoided taking ownership of the amps physical condition, the deep gouge and scratches shown in the pic, and NOT ONCE, did you ever offer any sort of an apology, or any sympathetic notions of any kind. Instead, you basically said tough shit on the tubes, (you said since I didn't give you a chance to respond, and went ahead and retubed it, it should be at my expense). Anybody who receives an amp that has an issue, would probably do as I did, and expect any reasonable seller to address.

You are not a reasonable seller. You lied about the amp being MINT, LIKE NEW, you lied about not seeing the damage to the tolex, (there's no way you could have missed it boxing it up), you offered to send me new tubes, but refuse to just reimburse me for the ones I bought?? My guess, you wanted to send a used quad you had laying around.. You packaged it poorly, and all just says to me you could care less! I can't ship it back, the box/packing material will not make another trip. The box you used was insufficient. I will be traveling all week, and don't have time to shop for a box, nor should I have to fork over $60-$70 to return it! I'd have to eat that, plus take my tubes out and eat $82 for the KT77's, and have no use for them?

THe way I see it,

1. You guys work out an agreement on an adjustment for the over all condition as described vs. actual physical condition.

2. The amp was probably advertised as having used tubes that worked, and you bought it assuming that. I think you two should share the cost of the new tubes, since he isn't obligated to provide NEW tubes (unless it stated that in his add) and he is obligated to provide working used tubes (unless stated that they were bad in the add).

Agreed. He said the tubes were fine when he used the amp, which is fine. But he also said the amp was like new, and that was obviously not true. He offered to send me new tubes, so it wasn't clear if they were new or used. I agree, I'd be able to meet in the middle on that one.

A JSX doesn't go for all that much. Since we are in an open thread, what did he charge you for it? Was it fair market value for a used amp not in new condition, or was it fair market value where you paid an upcharge because it was supposedly like new? If he sold you the amp for a lower than market value JSX, I don't know. If not, I would expect a few bucks back since you want to keep it. Your choice to return it and get a full refund through PayPal or keep it and work it out. If he doesn't move because he gave you a great deal, and you decide to keep it, then that's your choice.Move on. Paypal is not going to rule in your favor if you want to keep it. It's all or nothing, return it and get refunded through PayPal or not. I had this happen and got nothing back but it was my choice to keep the guitar because it was very good and what was not described( a headstock repair at the Low E tuner, was pretty significant. I did pay about 150 or so less than market value. I didn't file any claims because I kept it. I didn't out the guy either but after a week I would be pretty upset thinking he was blowing me off

It doesn't matter if he paid him fair market, $5, or $5000 - if the amp was described as being in a particular condition, but showed up in lesser condition, the buyer is entitled to compensation or a full refund. An agreement is an agreement - a leveling of terms and understanding.

I paid $565 shipped. Three on Ebay went for $305, $350, & $415. I paid more, (I believe), than fair market, based on the notion it was listed as MINT, LIKE NEW. I'm outing the guy, because he's refused to take ownership, and he's got some other amps listed - People should know who they're dealing with, a dishonest individual.

I am sorry OP had this happen. This is only relevant in the OP's decision to keep it and now look for compensation because the item was not as described on Ebay. He is fully protected on Ebay and I agree the seller should have listed it accurately and should also work with him on it. I would send him some cash back. At least $100.00. If he does not then the OP has the choice to return it for a full refund. The thread gives the impression the OP got scammed or ripped off when neither happened. Allot of sellers on Ebay list things as in like new condition when they are not. Send it back, get your cash back and move on.
You're not really warning anyone about a bad Dude. Actually he's a pretty good guy. He sold me a 6505 that was mint for a great price, packed it up very well, and shipped it the same day I sent him the funds by GIFT pay. This was on here though , not Ebay fwiw. He followed up with me to see if it arrived safely, etc. This was about a year ago so maybe something changed.

Problem with returning it is he would have to pay the return shipping and wouldnt recoup it.I had a PP dispute through reverb o an amp an d had to return it,was out the shipping, but at least I got my money back......not to mention buying tubes and the time of dealing with it.....one of the disadvantages of shopping online sometimes.....hopefully he will make good on at least the tubes......were there not pictures on the amp up with the add showing the tolex?I saw that about the footswitch and if that is the case, that is pretty lowdown......

No pics of the damage to the tolex. It's on the bottom of the amp, but don't see how it could have been "missed", or not known it was there!

Did you take photos of the packaging as you unpacked it? Pictures go a long way when it comes to getting some compensation from the seller and it show other potential buyers what they may be in for if they buy from him. Did the buyer take pictures when he shipped it? I do not trust anyone I sell to (especially on Ebay) and photograph everything including all serial numbers. Once I started doing that, honestly prevails and these problems disappear.
If I bought an amp and it had these problems I would not spend any money on it until I worked something out with the seller.
If the seller is working with you, take it off line until you reach an agreement.

I did take pics of the packaging, sent all to the buyer, and Reverb got involved and I sent them pics as well. I'm calling him out, because he's not taking responsibility whatsoever. I don't want to ship it back, I don't have time to find a box, (the one used can't be used again, its too flimsy), buy additional packing material, (again, what was used was insufficient), and pay shipping, 50lbs from FL to NM.. I just want an adjustment on the price, and some compensation for retube, (which I'd be happy to split). He did offer to send the footswitch he pictures, (I would hope so)!

I don't agree with a lot of what you have said, but we have had contact. You trying to play it out like I have not responded what so ever. My internet has been all messed up and has been up and down all week. I alerted you about that. You knew it would be a few days before I could respond to any more of your emails. You turned down my first offer and I responded to your paypal claim which is still open by the way. I am not gonna argue with you in an open forum. If that's what you wanna do that is fine but I will stick to communication thru reverb and Paypal.
