The biggest thing is that the tone is in the hands, as other people have mentioned.

You will want a hardtail guitar with an EMG 85 in the bridge and a more midrange oriented tone.

KSE have used so many different amps live and in the studio. Guess what, they always manage to get pretty much the same sound of them all... Rectifier, Splawn Nitro, Triamp MKII, Framus Cobra, Framus Dragon, Soldano SLO100, Diezel VH4, and probably a lot more. No matter what amp they use, they still sound the same. You could probably go with any modern-voiced, high gain amp and as long as you're tuned down a step and using an EMG 85 in the bridge of your guitar, you'll get pretty much the same sound.

I've recorded a video in the past with my Jackson, tuned down, with EMG 85 and, while it was recorded with my computer's built-in camera, it doesn't sound all that bad. I'm not the best player out there, but you'll get the idea I guess...

This clip definitely has the tone vibe.

KSE is currently using splawn nitro's live. The new album was The VH4 for rythym's and The nitro for leads, a tiny terror was also used for some overdubs.

Straight from the horses mouth. I'm trying to get Joel to give up his settings, well see.

Actually the Nitros are boosted with a TS808... very little of the new CD is VH4.

That's not true according to Joel, we discussed the tones on the new album in length this summer. I doubt hes wrong about his own guitar tracks.

Joel told me the new disc is Vh4 for all rhythms, Nitro for leads and some overdubs, and the tiny terror for some additional overdubs. and yes they boost with screamers as they always have.
