Stolen Marshall 2555SL on Ebay

Same thing happened here in Montreal to a guy i know but his was a trade. He shipped his guitar to a guy and the guy said never received it but it was delivered to his address. 5 months later he sees his guitar for sale on craigslist from the guy that said didn't receive. Cops said can't do anything
 
I hope ebay can do something but i don't see how they can get the funds from him now. Maybe ebay has insurance and once they realize he took you and them for a ride, they will refund you and ban him from ebay. Maybe they took the auction down and not him? Fingers crossed for you. I hate thieves.
 
Paypal sent me an encrypted email last night with the dates of purchase, refund, and status etc. I'll attach it here. It shows the date he paid on 4/6 and the date of the claims refund by ebay on 5/3.. also shows his initial payment status as refunded. Its in excel, so I couldn't attach it? anyway I took a pic of the log...

It’s not against the law to pay a visit with the receipt in hand in the county he lives with police presence requested to get your property. Have the original purchase receipt showing the serial number and claim it stolen.
Cops would have to have a search warrant to really do anything and that takes a Court order.

You own it. According to the loser he never received it, so if the serial numbers match, it’s just police presence while you gather stolen property.
A.The dude isn't going to answer the door. B. It's never that easy because if he does answer the door, it's going to most likely be a he said vs. he said situation. C. Depending on the police department, size, how busy they are etc., without legal documentaion, they most likely wont get involved in property retrieval in a civil situation.

OK, so what would that have accomplished? Even if it was a signature on delivery package couldn't a douche like Weddington still have claimed it was a box of rocks that weighed 45 lbs or something like that and went thru with the scam anyway?

I'm not familiar with what getting a signature for packages changes? Or would have changed in this case.

It’s for legalese reasons. The first check they have for legal action is did it actually get sent to his address and signed for. If not, then legally they have no recourse to be able to continue onto other checks that open the possibility of it being resolved correctly.
 
Ebay has moved the threshold dollar amount for signature confirmations over the years.. I think its just a couple hundred dollars now that must have the signature, or a savy person that knows the rules can claim that item never arrived- even when the tracking documents show the opposite.

I side with the original seller but unless he & the cops can root around inside & search the guys house with a Court order its he said/he said unless there is sufficient physical evidence.
Hunches based on internet chats won't stand up in Court.
The whole thing is outrageous to be honest.
 
It seems so much worse than normal thievery when a musician robs a fellow musician. It’s just extra scummy. I don’t know how you could enjoy playing a guitar or amp you stole from someone. I guess that depends on whether or not you are a sociopath.
 
Really sucks to hear and see this. However, I'm glad you were vigilant and called out this guy for what he is doing. Problem is, he is going to try and sell it to someone else and will probably get away with it. Just really scummy.
 
Here in NJ this past year anything that has been sent with sig required has been signed by the driver anyways. I havent signed for anything since 2019. They do take pics of it left at my door though.

That’s the beauty of the Internet. It never forgets. Id remind him that because private carriers are now covered under mail fraud and because this involves interstate commerce that it would he should make right since there is now price and multiple jurisdictions to include federal are now in play.

Just sent another message to the jackass.

I’d like to bring to your attention that the legal definition of mail fraud has now been extended to private carriers and since interstate commerce comes into play, this case can be investigated and prosecuted under federal jurisdiction. Federal crimes are also not eligible for parole. Simply put, the Internet never forgets. Selling an amp that was intentionally and fraudulently reported stolen will be easy to prosecute since there is now digital evidence. I suggest a course of action that will benefit yourself as well as the rightful owner of the amplifier in question.

Make sure you have the cops with you. It's this line of thinking that landed OJ back in the clink.
