More and more I'm starting to hate cops.

I don't know, I understand that 7K worth of equipment that has been stolen is not a big deal, of course I will have to work my ass off for another year or so to buy it back. Let's just have every peace of shit brake & steal our property & give them probation, fair exchange! Next time they will probably shoot me too & get a probation for that, ....no wait they won't, because I'll be dead, but when it comes to writing speeding & seatbelt & other bullshit tickets we are so prompt to do that. I'm sorry man, I don't get this. I do understand what you are saying though.

The guy brought 5 peaces of my equipment together, having no idea what they are & what they cost from the words of the employee who works in the shop. Why would he buy it?? That's either him or his friends - same shit!
This is a little suburb of Chicago, not a big area at all, low crime rate. I think they should have time to take care of my case.

Welcome to the State of Texas, where using deadly force to prevent misdemeanor theft or misdemeanor criminal mischief at night is defense to prosecution.

§ 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is
justified in using deadly force against another to protect land or
tangible, movable property:
(1) if he would be justified in using force against the
other under Section 9.41; and
(2) when and to the degree he reasonably believes the
deadly force is immediately necessary:
(A) to prevent the other's imminent commission of
arson, burglary, robbery, aggravated robbery, theft during the
nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing
immediately after committing burglary, robbery, aggravated
robbery, or theft during the nighttime from escaping with the
property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or
recovered by any other means; or
(B) the use of force other than deadly force to
protect or recover the land or property would expose the actor or
another to a substantial risk of death or serious bodily injury.

Sweet - that's good information. Much appreciated.

As far as suing you for harm to the invader, that's a civil court thing, not criminal. Anyone can sue you for any reason. It may not hold up in court but it'll cost you a bundle to defend yourself.

Yes, anyone can sue anyone for anything. But dead burglars rarely sue anyone.
True but their family will sue if they think they can make any cash off of you. If you have fat pockets they'll demand compensation for their "loss".

I hear it's lots worse in other countries, like England. The police there will arrest you for defending yourself and the courts will jail or fine you or both. No idea where Boogie444 is from though, so I couldn't tell you what his experience may have been.

My comments are only applicable to free citizens of the US, subjects in other countries will be governed under different statutes.

I like the juxtaposition of terms: free citizens of the US/ Subjects in other countries.
Free citizens FTW!

Thanks for the civil post Odin. My apologies for all the heated shit earlier.

Understand that the police want these assholes to rot in jail even more than you do. it's because of these criminals being back out on the street quicker than the police can complete their paperwork that the crime rate is high and the police are kept busy. But the police have no say in who gets let out of jail.

Also, buying stolen property is not a crime unless you know, or reasonably should have known, the property is stolen. And that is nearly impossible to prove in court. Your DA probably wouldn't even waste the time trying to prosecute the guys who were found with the equipment unless something linked them to the actual crime scene, which is nearly impossible.

And don't expect the police to spend much time doing the CSI routine over some stoeln property when there are women being beaten by their boyfriends, children being abused by their parents, etc... out there every hour of every day. The shit that goes on in your sleepy little town would shock you.

I was once a crime victim in a small town where i was playing a gig. I did most of the detective work for the little PD there and was pissed that their detective never made any progress. When i finally got to talk with him I learned that he was the town's only detective, and he had to work every case from murders to missing kids to stolen weedeaters. My case just wasn't priority. I didn't like that fact, but I understood it.

I've also been the victim of vehicle burglary 4 times and vehicle theft 1 time, all while living in Dallas. Hence, I bought a house in a nice neighborhood in the suburbs and I only go into Dallas to work and on rare occasions.

Free citizens can keep and bear arms without government interference. All others are subjects. Either you is, or you ain't. If you're free you know it, if you're not free don't accept it, work to change it.

You know the real sad part for me is neither what was stolen nor that I will or won't get it back, the problem is that I know that they are going to do this over & over again & basically will most likely never be held responsible for that. May be we should go back to 30s gang style, get some machine guns & just shoot these motherfuckers? :gethim:
I tried to get my gear insured & no insurance company wants to cover me, because I'm not a business & have "too much equipment for personal use"(their words). So WTF am I supposed to do? I guess I just need a psychologist.
